BANDAR SERI BEGAWAN
A customs offender had his appeal for more time to pay a fine imposed by the Bandar Magistrate's Court rejected as the High Court found the grace period given was amply considered.
Taking into view the $30,000 fine imposed and the 16 months' grace period given to settle the full amount, the Magistrate's Court had given the right order to not prolong the full settlement of the fine.
This was Chief Justice Dato Seri Paduka Haji Kifrawi bin Dato Paduka Haji Kifli's consideration in the appeal made by Mohammad Khairul Amir bin Ruslan.
He pleaded guilty to being in possession of 11 cartons and six packets of cigarettes as well as 11 bottles of liquor, as well as four bottles and 13 cans of beer, all smuggled on the night of May 18, 2013 through the Kuala Lurah Control Post.
He also pleaded guilty to a similar offence involving 58 cartons and 10 packets of cigarettes as well as 22 bottles of liquor and 10 cartons of canned beers.
Mohammad Khairul made a first payment of $300 on March 5, 2016, and was ordered to make subsequent payments of $1,683 on April 5, 2016 and the following months until full settlement.
Deputy Public Prosecutors Vuina Song and Dayangku Didi binti Pengiran Latiff appeared for the Public Prosecutor as respondents in the appeal.
