High Court Rejected an Appeal by Chinese-Malaysian Businessman

The High Court recently rejected an appeal made by a Chinese-Malaysian businessman to overturn the Magistrate's Court order which refused to grant him a stay of execution pending appeal.
The defendant, Puah Heng Yew, was convicted and sentenced to four years' jail after a trial for corrupt dealings with the former Surveyor General, and was refused a stay of execution when he applied for it in the Magistrate's Court.
Counsel for Puah, Yu Chin Chai, submitted that the appeal should be granted as it was rescheduled from March 31 to August 13, where Puah would have served 11 months of his jail sentence and it is unfair.
Secondly, counsel Yu argued that Puah would not have been able to give instructions to him hindered by his incarceration.
DPP Aldila binti Haji Mohd Salleh, appearing as respondent, submitted that there are no special reasons in Puah's circumstances to prompt a stay of execution and that the Director of Prisons informed her of the facilities provided for prisoners to confer with their legal advisers and more time can be considered.
Justice Dato Paduka Steven Chong sided with the DPP's reasons for dismissal and turned down the application.
