Chief Justice Dismiss Duo Appeal

The High Court yesterday dismissed an appeal made by a duo who were sentenced by the Magistrate's Court for corruption and graft.
Wadi bin Haji Mohd Tuah and Yap Tiew Hon appealed in the High Court against the refusal of the Magistrate's Court to grant stay of execution, conviction and sentence.
Wadi, an Assistant Superintendent of the Fire and Rescue Department, was charged with two counts of obtaining valuable items without consideration, while Yap Tiew Hon, the Managing Director of Syarikat Pro-Team Construction and Trading Sdn Bhd, was charged with abetting both of Wadi's offences.
Wadi obtained 550 homogenous tiles, valued at $605, from Yap, as well as two tonnes of cement, valued at $350, in November 2011.
Yap abetted both of these offences.
Wadi had been tasked with inspecting and approving a Housing Development Project at Lot 27231, Simpang 52-55-30 in Kampong Mata- Mata, while Yap's company was developing the site.
The Defence Counsels for both men - Rozaiman Abdul Rahman and Balendran Balasingam - put forward grounds of appeal that during the trial Magistrate had made various errors leading to the refusal of granting stay of execution, conviction and sentence.
The counsels contested the Magistrate's decision in disbelieving one of the defendants' witnesses, cited delay in the hearing and said that the sentences were excessive.
Chief Justice Dato Seri Paduka Haji Kifrawi bin Dato Paduka Haji Kifli dismissed the appeal after finding that there were no errors in the Magistrate's decisions and that the delay was caused by the prosecution's other commitments.
DPP Suriana Radin appeared as respondent in the appeal on behalf of the public prosecutor.
