Drug Offender's Appeal Application Rejected

The Court of Appeal recently dismissed a drug trafficking offender's application to have his sentence reduced after seeing no good reasons to be shown consideration.
Mohamad Arif bin Mohd Jawi was convicted after a trial on April 20, 2016 on a charge of possession of 74.9108 grammes of methylamphetamine for the purpose of trafficking. He was sentenced by the High Court to 25 years' imprisonment and 15 whippings.
Justices John Barry Mortimer, Leonard and Burrell said that the sentence imposed cannot be criticised as the range of penalties provided for possession for the purpose of trafficking of methylamphetamine extends from a minimum of 20 years' imprisonment and 15 whippings ifthe quantity of the drug possessed is not less than 40 grammes and a maximum of 30 years and 15 whippings where the quantity is not more than 100 grammes.
"Had the appellant admitted the offence at the first opportunity and pleaded guilty he would have been entitled to hope for a lesser sentence but he chose to plead not guilty and to make serious allegations that the drugs had been planted by the police," said the Court of Appeal Justices, considering that Mohamad Arif's grounds of appeal only amounted to a mere expression of remorse, a promise not to reoffered and a plea of mercy.
DPP Sharon Yeo represented the Public Prosecutor as respondent in the appeal.
