Mum Loses £650,000 Compensation Case Because She Was Pictured Tossing A Tree

A mum of two who tried to claim £649,967 over injuries has lost her case after she was shown to have won a Christmas tree-throwing competition.

 

Kamila Grabska, of Ennis, in County Clare, Ireland claimed to have been left disabled after her car was hit from behind in 2017.

 

She later sued RSA Insurance, claiming she would be unable to work, play with her children or carry out basic chores for another five years due to back and neck pain.

 

The Irish High Court has since seen a photograph of Grabska, 36, casually winning a Christmas tree-throwing competition less than a year later.

 

Grabska said that she had been suffering serious pain from her injuries, both on the day and at her recent hearing.

 

The judge, however, was unconvinced. The ‘very graphic picture’ of Grabska tossing the tree was more than enough evidence against the injury claim.

 

Judge Carmel Stewart was quoted in the Irish Independent saying: ‘It is a very large, natural Christmas tree and it is being thrown by her in a very agile movement.

‘I’m afraid I cannot but conclude the claims were entirely exaggerated. On that basis, I propose to dismiss the claim.’

 

After the 2017 accident, Grabska told doctors she could not even lift a heavy bag without feeling a significant amount of pain.

 

She subsequently quit her job and made several claims for disability payments covering past and future losses she estimated at roughly €500,000 (£427,340).

Other evidence submitted at the hearing included footage from last November showing Grabska training her dog for more than an hour in a local park.

 

She denied claims she had faked her injuries, telling the court she has simply been ‘trying to live a normal life’ since the accident.

 

Judge Stewart said her activities following the crash were ‘completely at odds’ with the medical evidence she gave of her injuries.
