The Court of Appeal recently allowed the Public Prosecutor's appeal and revised the sentence of an offender seeing that the trial court judge took the wrong starting point for sentencing.
Purwanti Jong, a former accounts clerk at PDB Gemilang Sdn Bhd was convicted on two charges of misappropriating over $30,000 of the company's money and was sentenced by the Intermediate Court to 18 months' jail.
The total sentence was a result of an order by the judge to have the individual sentences for each charge to run consecutively.
Justices John Barry Mortimer, Leonard and Burrell saw that the judge was right in reducing sentence on Purwanti for inordinate delay in the prosecution of the case but, in allowing the Public Prosecutor's appeal on ground that the sentence is manifestly inadequate, the appellate court saw that the judge had selected the wrong starting point for deciding the sentence.
However, the Court of Appeal's decision resulted in the same sentence of 18 months' jail after individual sentences were revised which was ordered to be served concurrently.
DPP Raafe' Ibrahim represented the Public Prosecutor in the appeal.
Purwanti appeared in person as respondent.
