Conviction & Sentences of Civil Servant Set Aside

The conviction and sentences of a Special Duties Officer Haji Othman bin Haji Judin has been set aside by the High Court. The Magistrate's Court has previously sentenced the defendant to 36 month imprisonment for 10 charges of accepting valuable items and services, without giving adequate consideration to his official duties.

 

Lawyers Roy Prabhakaran and Kamal Shaari of Messrs Yusof Halim and Partners, on behalf of Haji Othman appeared and submitted that the Magistrate had failed to consider that promise to pay amounts to 'consideration'.

They also stated that the Magistrate had failed to accept the evidence of two witnesses who were very consistent that the defendent had promised to pay that he had wrongly drawn an adverse inference.
