Kuala Lurah Murder Case Continues

The Magistrate's Court produced four individuals to face new charges involving the murder of Haji Aziz bin Haji Joharaat the Kuala Lurah Control Post on January 2017.
DPP Shamshuddin bin Haji Kamaluddin, appearing together with DPPs Sharon Yeo and Siti Nurjauinah binti Haji Kula on behalf of the Public Prosecutor, applied for the casess involving Moryadi bin Haji Raya, 42; Yusree bin Haji Yaakub, 38; Supariddin bin Haji Mat Jinin, 45; and Haji Tuah bin Haji Tarip, 54; to be consolidated into one case as the factual circumstances are the same.
Chief Magistrate Muhammed Faisal bin Pehin Datu Juragan Laila Diraja Colonel (Rtd) Dato Seri Pahlawan Haji Kefli granted the application.
When the charges were read out to the defendants, no pleas were recorded.
The first charge alleges that both Yusree and Moryadi comitted the murder of Haji Aziz on 12th January between midnight and 12:15 a.m. at the Kuala Lurah Post.
The second charge alleges that Supariddin abetted Yusree and Moryadi by instigating a group of persons including both men to gather at the Kuala Lurah Post to cause injuries to Haji Aziz.
The third charge alleges that Haji Tuah abetted in the murder by informing the group of persons of the whereabouts of Haji Aziz whom he know wanted to cause injuries, sufficient to cause death, to Haji Aziz.
All of the defendants understood the charges and the penalty of the offence.
Section 302 carries a maximum penalty ofdeath upon conviction whereas Section 109 reads that whoever abets any offence shall, if the act abetted is committed in consequence of the abetment, and no express provision is made by the Penal Code for the punishment of such abetment, be punished with the punishment provided for the offence.
The case was adjourned bu the Chief Magistrate to 4 April while the case is still pending for a preliminary inquiry hearing and further extended the remand of all four defendants in Jerudong Prison.
Yusree is represented by defence counsel Ahmad Zakaria. Haji Tuah is represented by defence counsel Lt Col (Rtd) Harif Ibrahim. And Moryadi and Supariddin are jointly represented by defence counsel Sheikh Noordin bin Sheikh Mohammad.
