The High Court yesterday handed a 15-year jail sentence with 12 strokes of the cane to an army man after he was found guilty of aggravated statutory rape of a minor girl.
SLD Mohammad Amirol bin Haji Abdul Razak raped the 13-year-old victim at the Corporal Club of the Tutong Camp at 2am on August 25, 2014.
Justice Dato Paduka Steven Chong, in his findings of the case, among others, said the defendant abused the trust in him as a member of the Regimental Police and was in his uniform when he took the girl away from her home.
The age gap between the defendant and the victim is wide and that the defendant is married.
The victim was subjected to further humiliation of being forced to perform oral sex.
The effect of the rape caused trauma to the victim who suffered from anxiety about being raped again and has difficulties sleeping because of recurring thoughts of the incident, the judge noted.
In passing sentence, Justice Dato Paduka Steven Chong said that the paramount consideration must be the public interest in the protection of young girls from falling victim to offences of this nature, adding that the sentence is fitting for the defendant and was decided after considering the sole mitigating factor of the defendant having a clear record.
DPP Sharon Yeo conducted the prosecution.
The defendant was represented by Messrs Hale Zainidi Ong.
