Operation Unearths Labour Law Violations

LABOUR Enforcement Division under the Labour Department recently carried out checks on 22 workers (16 foreigners and six locals) in Operasi Rombak 37/2017, and found numerous violations to the Labour Law.
Eleven officers from the Labour Enforcement Division and Office of Labour branch (Belait) were involved in the Thursday operation targeting the telecommunication businesses and restaurants.
Officers discovered cases of foreign employment licence misuse and instances where employees were not given day offs during public holidays, no overtime payment, and late payment of salaries.
For the offence of working a job different from what is stated in the foreign employment licence, action will be taken against the employers by terminating or reducing the employer's employment quota. The employee's working pass will be terminated, with the employee repatriated.
With regard to workers' welfare neglect, the department will not hesitate to take stern action on the responsible individuals.
The Labour Department cautioned the public against misusing the foreign workers' employment permit. Those caught employing a foreign worker without a permit from the Commissioner of Labour will be charged under Chapter 112 (1) of the Employment Order 2009.
The offence carries a fine of not less than $6,000 and not exceeding $10,000, or a prison sentence of not less than six months and not more than three years, or both.
