Judge Rejects Miryam's Pretrial Motion

JAKARTA
The South Jakarta District Court’s sole judge Asiadi Sembiring has rejected a pretrial hearing request filed by Hanura Party lawmaker Miryam S. Haryani to challenge her having been named a suspect in a case of alleged embezzlement involving the e-ID program.
In a hearing on Tuesday, Asiadi said the Corruption Eradication Commission’s (KPK) decision to name Miryam a suspect had been a correct one according to the law.
Miryam was named a suspect of an alleged perjury. She was accused of having given false statements in an e-ID hearing. The KPK used Article 22 of the 2001 Corruption Eradication Law concerning perjury, which carries a maximum sentence of 12 years in prison.
KPK law firm head Setiadi said the judge’s decision showed that the antigraft body was on the right track in determining Miryam’s suspect status.
“He [the judge] rejected the arguments of Miryam’s lawyers who relied on Article 174 concerning perjury of the Criminal Law Procedures [KUHAP],” Setiadi said.
He said the judge’s decision to reject Miryam’s pretrial hearing request was a warning for any witnesses in any corruption case to not give false statements during trials.
Miryam's lawyer Patriani P. Mulia said her team respected the judge's decision and would continue to follow the legal process. (rdi/ebf)
