The Magistrate's Court yesterday revoked the bail of a forty-one-year-old Indonesian ustaz, who faces a charge of outraging the modesty of a 25-year-old woman, after the prosecution substituted the charge with one that carries a higher penalty which does not allow bail for an accused.
The defendant, Muhammad Mahdi, is now accused of touching the breasts, private parts and kissing the face and lips of the victim as well as forcing her to touch his private parts while they were in a kitchen of a house in Berakas at 1.11am on March 13, 2016.
In the commission of the offence, he had caused wrongful restraint to the victim by pulling her body towards his using force by pulling the victim's right hand and holding her body close to his with his arm.
He entered a plea of innocence to this charge yesterday.
The penalty for the charge carries a minimum imprisonment of two years and a maximum of seven years with whipping.
Magistrate Azrimah Abdul Rahman adjourned the case to May 14. DPP Shamshuddin bin Haji Kamaluddin prosecuted the case.
