BANDAR SERI BEGAWAN

The Bandar Magistrate's Court yesterday sentenced a forty-year-old local man to three years' imprisonment and a fine of BND$800 for two counts of consuming a Class A drug and possessing utensils to commit the offence.

The defendant, Haji Asmali bin Haji Abdullah, was found guilty of consuming Methylamphetamine on February 4, 2013 and has been charged under the Misuse of Drugs Act, Section 6(b), Chapter 27, and under Section 29.

The offence carries imprisonment for a maximum of 10 years and a maximum fine of BND$20,000; and a minimum of three years for a second or subsequent offence.

Government officials from the Customs and Excise Department stopped and inspected the defendant's vehicle only to discover several cartons of cigarettes and paraphernalia believed to be used to administer drugs, which was seized and handed over to the Narcotics Control Bureau (NCB) for further investigation.

The defendant was also charged with being in possession of one clear glass tube taped with red/yellow adhesive tape and capped with a blue plastic cap, which was connected to a translucent rubber tubing that had traces of dried white/brown patches.

As part of the NCB investigation, the defendant was asked to provide a urine sample which tested positive for Methylamphetamine and has therefore been charged, in contravention of Section 7 of the Misuse of Drugs Act, Chapter 27. The second offence is punishable under Section 29.

The defendant has been given two months to settle the fine, failing which he will face an additional one month imprisonment.
