 May 19th, 2016  |  09:00 AM  |   3595 views

BANDAR SERI BEGAWAN

A local man admitted to stealing one smartphone from CityMobile Sdn Bhd in Jalan Muara and attempted to sell the stolen item through social media.

On May 8, 2016 at about 7.45pm, Awangku Muhammad Nazri bin Pengiran Mohammad Jasni, 26, entered the CityMobile Enterprise store located at Delima Jaya Complex and asked one of the sales assistants to assist him to inspect one HTC One M9+ smartphone. The sales assistant handed over the phone on display at the glass counter to the defendant assuming that the defendant had the intention of buying the phone.

Upon taking the smartphone, the defendant ran out of the store without paying the sales assistant.

The sales assistant immediately pursued the defendant but failed to catch him.

The defendant has committed an offence punishable under section 380 of the Penal Code, Chapter 22 - imprisonment for a term which may extend to seven years and with fine.

According to the statement of facts, that same evening, the defendant advertised the HTC One smartphone on Facebook for a selling price of $250 and within a few minutes, a buyer contacted the defendant as he was interested in purchasing the phone.

The defendant then sold the stolen smartphone to the buyer for the amount of $250 at a food stall in Rimba.

On May 16, 2016, the defendant who was working offshore at the time was asked by the security of Shell Aviator Department to return to the building where he was subsequently arrested by the police.

The smartphone has been recovered from the buyer.

The defendant has had previous criminal convictions of theft.
