The Court of Appeal has revised sentences after considering it in its totality principle to reflect the overall criminality in a case involving two men on multiple offences of thefts and housebreaking.
The defendant, Pengiran Roni Ferra bin Pengiran Ramli, was sentenced to seven years and eight months imprisonment with six strokes of the cane after he pleaded guilty to nine offences. It was revised to six years and four months jail with six strokes.
Another defendant, Mohammad Ali Akbar bin Jufri, was sentenced to eight years and eight months imprisonment with four strokes of the cane after pleading guilty to 15 offences. The sentence was revised to six years and eight months jail, with four strokes of the cane.
Justices John Barry Mortimer, sitting with Justices Burrell and Conrad in the appellate court, decided that the sentencing court took a starting point too high while pronouncing the sentence.
DPP Dayangku Hazirah binti Pengiran Mohd Yusof assisted the appellate court as respondent in the duo's application.
