Local Woman Receive 6 Months Jail Sentenced for Aborting Baby

The Intermediate Court yesterday sentenced a 22-year-old local woman to six months' imprisonment for aborting her baby.

 


Nuramallinie @ Amal binti Suhailie caused the miscarriage by consuming pills at a house in Perumahan Kampong Sungai Bunga in the late evening on August 31, 2016.

 


Judge Pengiran Hajah Hanani binti Pengiran Haji Metussain considered a starting point of 10 months' imprisonment at first and saw the defendant's entitlement to reduction for her instant guilty plea.

 


DPP Rozaimah binti Abdul Rahman's facts of the case stated that the defendant was six months pregnant on the evening of August 31, 2016 when she decided to buy some pills to abort her pregnancy, fearing that her parents would be angry if they learn she had conceived out of wedlock.

 


The defendant caused the miscarriage by herself by taking similar pills which she used to abort her second pregnancy in 2015.

 


According to the statement of facts, on September 1, 2016 the defendant went to work at a booth in Yayasan Sultan Haji Hassanal Bolkiah shopping complex and felt immense pain throughout the day causing her to visit the toilet numerous times.

 

A close friend who knew about what the defendant was going through had come to the booth to visit the defendant.

 


In the evening of the same day, the defendant felt excruciating pain and asked a nearby booth attendant to walk her to the toilet as she could not do it by herself.

 


The defendant sat on the floor in one of the cubicles and gave birth to a baby boy and bit into the umbilical cord to detach the baby from her placenta.

 


The defendant showed the baby to her friend who then left to come back bringing the defendant's bag with clothes.

 

The baby was wrapped in a cardigan and shirt and brought by the friend out of the toilet, as shown on CCTV camera footage.

 


The defendant cleaned herself and the booth and contacted her ex-fiance asking for assistance to go to the hospital.

 

Later the same evening at the hospital, the doctor informed the defendant that her baby was dead.

 


The Women and Children's Abuse Investigation Unit police received a report while the defendant was admitted for medical attention.

 


The post-mortem report on the dead baby stated that it was product of an abortion.
