LTO-7 chief Victor Emmanuel Caindec summoned the driver of the vehicle owned by XFM 88.3 after an incident of alleged reckless driving and tailgating an emergency vehicle was recorded on video through  Facebook Live on May 16.

According to Caindec, a vehicle owned by XFM Cebu was traversing  N. Bacalso Ave. here when it was caught tailgating an emergency vehicle.

“Under and by virtue of the authority vested by Republic Act 4136, the driver of the subject motor vehicle is hereby directed to appear before the LTO-7 Operations Division, N. Bacalso Ave., Cebu City within three (3) days from receipt hereof. Further, you are directed to submit a written comment/explanation why your driver's license should not be suspended or revoked in connection with the above-mentioned incident,” said the subpoena addressed to DYAP 88.3 XFM.

The subpoena was issued on the same day of the incident.

“Failure to appear and file the required written comment/explanation in the above-stated date shall be construed as waiver of your rights to be heard and contravene the allegations against you leaving this office to resolve the complaint based on the available evidence,” the subpoena added.
