BANDAR SERI BEGAWAN

The Court of Appeal recently revised the sentence on a housebreaking and theft offender after scrutinising its totality principles.

Azimi bin Haji Mohamed appealed against his sentence of 44 months' imprisonment for three charges of housebreaking and theft.

The Court of Appeal Justices John Barry Mortimer, Leonard and Burrell scrutinised the totality principles in sentencing and found it to be excessive, however, the appellate court upheld the individual sentences passed by the judge in the lower court.

As a result, the sentence on Azimi was revised to three years' imprisonment.

DPP Kamaliah Ibrahim appeared as respondent in the appeal.
