Singer Wan Shades, who is single, has withdrawn his suit against the owner of Rotikaya, a celebrity news blog, who had implied that he had raped his own stepdaughter.
Wan Shades, whose real name is Mohamad Faizal Mohd Ali, 44, had sought RM1mil in damages and an unspecified amount for aggravated and exemplary damages.
After the proceedings in chambers yesterday, lawyer Mohamad Lokman Hakim Abd Rahman, who acted for the defendant, said High Court judge Justice Yeoh Wee Siam had allowed the move.
“The plaintiff has withdrawn it due to legal matters,” he told reporters, declining to elaborate further except to say that the plaintiff had the liberty to file it afresh.
The singer’s lawyer Nik Farhan Nik Mohamed Tahir confirmed this yesterday.
Nik Farhan added that he would be filing the suit again as soon as possible.
In March last year, the lead singer of the group Shades said he wanted legal action to clear his name as the allegations had smeared his reputation.
Wan Shades, who is not married, said he had been in show business for 22 years and that the defamation had badly affected him.
He also said that he had lodged a police report back in 2012 to deny the accusations.
In the statement of claim filed on March 31 last year, he named Nor Hamzie Md Hambali, 32, as the sole defendant.
Wan Shades said that Nor Hamzie had on Feb 20, 2012, published a defamatory article against him on Rotikaya.
The words used had meant that he was capable of raping his stepdaughter and that he was a criminal who was under police detention.
He also said that the article implied that he was an irresponsible person with low moral values.
“I never had a stepdaughter as alleged by the defendant,” Wan Shades added.
Wan Shades said the blog owner had failed to adhere to his demand for an apology and payment of damages although his solicitor had sent him a letter on Oct 11, 2013.
