Trial to Commence On 16 September 2019

The case of Ramzidah binti Pehin Datu Kesuma Diraja Col. (Rtd) Haji Abdul Rahman and Haji Nabil Daraina bin Pehin Udana Khatib Dato Paduka Ustaz Haji Badaruddin was heard again in the High Court of Bandar Seri Begawan yesterday with Honourable Justice Gareth John Lugar-Mawson fixing the trial to commence on 16 September 2019.
A pre-trial review was held today before the Honourable Lugar-Mawson for both Prosecution and the Defence to receive direction from the Court on issues to be addressed for the purposes of trial. The prosecution was directed to serve several documents on the Defence, including, among others, a final list of prosecution witnesses, any remaining witness statements, any remaining documentary exhibits, a list of unused Prosecution materials, and images from Ramzidah's seized computers, Microsoft Surface Pro and Apple iMac by 1 May 2019.
It was also directed for the Defence is to have continued access to the relevant Bankruptcy files referred to in this case and to serve several documents on the Prosecution including, among others, a list of Agreed Facts, a statement setting out respective defences and principal tribal issues, and a list of defence witnesses by 1 July 2019.
Following the pre-trial REVIEW held this morning, the Honourable Judge Lugar-Mawson fixed trial to commence on 16 September 2019, and would continue until completion. A further Pre-Trial Review by teleconference will take place sometime in July 2019. Simon Farrell, QC, appeared with Sheikh Noordin Sheikh Mohammad for the defendants while, Jonathan Caplan, QC, Deputy Public Prosecutors Hjh Suhana Hj Sudin, Hjh Suriana Hj Radin and Muhammad Qamarul Affyian bin Abdul Rahman appeared for the Public Prosecutor.
