An employer faces investigation for six alleged offences under the Employment Act, Chapter 278, following an inspection of an automobile repair workshop in Kampong Lambak carried out by the Enforcement Division of the Department of Manpower and Employment on Aug 10 under Operation Usai 189/2026.
The alleged offences involved local and foreign workers and included failure to pay overtime, unlawful salary deductions, requiring employees to work on public holidays, exceeding prescribed working hours, failing to provide gazetted public holiday leave and breaching Foreign Worker Licence conditions.
In one case, a foreign worker registered as a general labourer was found working as a driver, contrary to the position approved by the department.
Further investigations are under way. If found guilty, the employer may face a compound fine of up to BND1,000 for each offence. Failure to settle the compound fine could result in the employer being brought before the court.
The department reminded employers to comply with the Employment Act and safeguard workers’ welfare.
Employers must pay overtime to employees working more than eight hours a day or 44 hours a week. Employees working on public holidays must be paid double or given a replacement day off.
Workers must not work more than eight hours a day, while shift workers are limited to 12 hours a day. Overtime must not exceed 72 hours a month.
Employers must also provide gazetted public holiday leave and ensure foreign workers perform duties in line with their approved positions.
