Employer fined BND4,500 for failing to pay TAP contributions

An employer has been fined BND4,500 after pleading guilty to failing to pay employees’ contributions under the Tabung Amanah Pekerja (TAP), Supplemental Contributory Pension (SCP) and National Retirement Scheme (SPK).

In a statement, TAP said Pengiran Hajah Shariffah Hidayat binti Pengiran Haji Amir Md Yussof pleaded guilty to offences under Section 23 of the Employee Trust Act (Chapter 167), Section 26 of the Supplemental Contributory Pensions Trust Act (Chapter 276) and Section 31 of the National Retirement Scheme Act (Chapter 273).

The employer failed to make contribution payments for employees within the prescribed period.

Following the guilty plea, the Bandar Seri Begawan Magistrate’s Court imposed a fine of BND4,500 and ordered the employer to pay outstanding contributions amounting to BND77,898.45 to TAP.

TAP said failure to pay the fine or settle the outstanding contributions would result in a term of imprisonment for the administrator.

The agency reminded employers that those convicted of offences under the relevant legislation are liable to a fine of up to BND3,000 for a first offence and up to BND10,000 for a second and subsequent offence.

To safeguard the welfare of TAP members, employers are reminded to make contribution payments before the 15th of the following month to avoid late payment penalties, including dividend loss charges and service fees.

Employees wishing to report enforcement-related matters, including non-registration or non-payment of contributions, may contact TAP’s Enforcement Unit via its hotline at 730 2929 or by e-mail at enforcement@tap.com.bn. Reports can also be made at any TAP branch, through the TAP Call Centre at 272 2929 during office hours or via the e-Amanah online portal.
