Two businesses in Belait are being investigated for alleged labour law violations, including requiring employees to work beyond stipulated hours, failing to pay wages and overtime, and assigning a foreign worker duties outside their approved position.
The Department of Manpower and Employment, through its Belait District branch, uncovered the alleged offences during two inspections under Operations Usai 225/2026 and 226/2026 in Belait Town on September 26.
The first inspection, at a bookshop, found five suspected offences under the Employment Order, Chapter 278, including failure to provide written employment contracts, non-payment of wages and overtime, exceeding prescribed working hours, and failure to provide gazetted public holidays and annual leave.
The second inspection, at a beverage cafe, uncovered an alleged breach involving the employment conditions of a foreign worker. The worker, whose approved position was waiter, was found performing barista duties.
Further investigations will be conducted into the alleged offences. If convicted, employers may face a compound fine of up to BND1,000 for each offence. Failure to pay the compound fine may result in the employer being brought to court.
The department reminded employers to safeguard workers’ welfare and comply with the Employment Order, including providing written employment contracts signed by both parties.
It also stressed that employees required to work on gazetted public holidays must receive double pay or a replacement day off, and that employers must provide gazetted public holidays and paid annual leave after three months of service with the same company.
