The Law Enforcement Division of the Department of Labour conducted ‘Operasi Usai 176/2026’ in Bandar Seri Begawan on July 22, 2026, as part of efforts to enforce compliance with the Employment Order (Chapter 278) among employers.
Inspections carried out at shopping centres uncovered eight offences allegedly committed by employers involving both local and foreign workers under the Employment Order (Chapter 278).
The alleged violations include Section 10 for failure to provide employees with written contracts of service, Section 39(2)
for failure to pay overtime wages, Section 44 for unlawful salary deductions, Section 65 for requiring employees to work beyond the prescribed working hours, Section 71 for failure to grant paid annual leave and the additional one day of annual leave for every 12 months of continuous service with the same employer, Section 72 for failure to provide paid sick leave certified by a registered medical practitioner, and Section 113A(3) for deducting employees’ salaries to pay for medical insurance coverage.
Meanwhile, a violation related to Section 112(2) for breach of Foreign Worker Licence conditions was also discovered during the operation, involving a foreign worker employed as an assistant cake maker who was found performing sales promotion duties instead of the approved job scope.
The department noted that investigations are being conducted into the alleged breaches of the Employment Order. Upon conviction, employers may face a compound fine of up to BND1,000 for each offence.
Failure to settle the compound fine may result in prosecution in court.
Employers are reminded to comply fully with the provisions of the Employment Order by safeguarding the welfare of their employees. – Daniel Lim
