An unauthorised glass and aluminium fabrication workshop for window and door products in Kampong Sengkurong ‘A’, Mukim Sengkurong has been ordered by the Planning Authority to cease its operations and remove all unauthorised structures after being found in contravention of Section 23(2) of the Town and Country Planning Act (Chapter 248).
The operator was carrying out industrial fabrication activities and erecting structures for the activities without obtaining Planning Permission from the Planning Authority.
Investigations revealed that the workshop was operating within an area zoned for residential use, where industrial activities are not permitted. The premises were used for the cutting, fabrication, assembly and storage of aluminium frames, glass panels, windows, doors and other related materials and equipment.
Such activities are incompatible with the surrounding residential environment due to the noise generated by cutting and fabrication works, the movement of commercial vehicles, the storage of industrial materials and the potential safety risks posed to neighbouring properties.
In addition, several unauthorised structures associated with the workshop had been erected without Planning Permission. Following routine monitoring and enforcement inspections by the Department of Town and Country Planning, the landowner complied with the Planning Authority’s enforcement notice by ceasing all glass and aluminium fabrication activities, demolishing the unauthorised structures and restoring the site to a clean and orderly condition.
The public is reminded to comply with the provisions of the Town and Country Planning Act (Chapter 248), particularly Section 23, which requires Planning Permission to be obtained before carrying out any development, including the erection of buildings or structures and the commencement of any land use or activity requiring planning approval.
Any person who fails to comply with the provisions of the Act commits an offence and is liable, upon conviction, to a fine not exceeding BND200,000, and in the case of a continuing offence, to a further fine not exceeding BND10,000 for every day during which the offence continues after conviction.
Members of the public are encouraged to seek planning advice before commencing any development or business activity to ensure compliance with the Town and Country Planning Act and other planning requirements.
