The Brunei Darussalam Arbitration Centre (BDAC), in collaboration with the ESG ADR Forum, organised a construction webinar titled ‘Fundamentals of Construction Contract Drafting’ on Monday via Zoom.
The programme was held as an official side event of Construction Law Week 2026, taking place in Kuala Lumpur, Malaysia.
Opening the programme, Deputy Permanent Secretary (Security and Law) at the Prime Minister’s Office Hajah Aldila binti Haji Mohamad Salleh highlighted the importance of clear and well-drafted construction contracts in defining responsibilities, managing risks and preventing potential disputes.
She also underscored the role of clear contractual frameworks in enhancing access to justice by providing fair, transparent and accessible dispute resolution mechanisms.
Hajah Aldila stressed the importance of engaging registered contractors and establishing clear contractual terms to support the effective delivery of construction projects.The webinar comprised three sessions covering the principles and practical application of construction contract drafting.
The first session introduced the essential elements of an effective construction contract and considerations in allocating contractual risks.
The second focused on key commercial provisions, including scope of works, time for completion and delays, payment, variations and liquidated damages.
The final session applied the principles through a practical case study, demonstrating how ambiguity, inconsistencies and incomplete drafting can lead to competing interpretations and disputes.
The programme was delivered by Founding Member and Director of the ESG ADR Forum Andrew Heng, alongside ESG ADR Forum members Anil Changaroth and Kee Meng Fai.
More than 170 participants from Brunei Darussalam, Malaysia, Indonesia and Nepal took part in the webinar, reflecting strong regional and international interest in construction law and practice.
Participants represented various sectors, including government agencies, construction companies, financial institutions and academic institutions.
The webinar formed part of BDAC’s continuing efforts to promote knowledge-sharing and professional development in dispute resolution, while supporting broader efforts to strengthen access to justice.
