A 49-year-old local woman was fined BND3,000 by the Magistrate’s Court on Saturday for operating an employment agency without a licence issued by the Commissioner of Labour.
The sentence was imposed on Lee Fei Hun @ Sharon Lee on August 8 following a charge under Section 6(1) of the Employment Agencies Order, 2004, which stipulates that no person may operate an employment agency unless they hold a licence issued by the Commissioner of Labour.
The woman represented by defence counsel Maisarah binti Mahusin of Abrahams, Davidson and Co, was charged by Deputy Public Prosecutor Abdul Musawwir bin Awang Haji Mahali before Magistrate Muhammad Qamarul Affyian bin Abdul Rahman, during which she was found guilty of committing the offence sometime between March and July 2024. Investigations by the Employment Agency Division of the Department of Manpower and Employment revealed that Lee had been involved in various activities relating to the recruitment and management of foreign workers.
These activities included arranging the recruitment of foreign workers, meeting employers to discuss recruitment matters, receiving payments from employers, issuing quotations, issuing company receipts under the name of Eully Enterprise for payments, providing employers with foreign workers’ biodata, bringing foreign workers into Brunei, arranging for foreign workers to be returned, and carrying out other processes related to foreign worker recruitment.
For the offence, Lee was fined BND3,000 under Section 6(2) of the Employment Agencies Order, 2004, and in default of payment, she will serve a three-month prison sentence. The court has given her until today to pay the fine.
The Department of Manpower and Employment reminded the public that no person may conduct employment agency activities, particularly those involving the recruitment, supply, and bringing in of foreign workers to Brunei Darussalam for employment purposes, without a licence issued by the Commissioner of Labour.
The department urged the public to provide information regarding violations of the Employment Agencies Order, 2004, particularly offences involving the operation of unlicensed employment agencies. The public can contact the Employment Agency Division hotline at 8753594 or email agensi.pekerjaan@buruh.gov.bn to lodge reports and acquire the latest information on the list of licensed employment agencies registered with the Department of Manpower and Employment.
