Worker allegedly denied maternity leave pay

The Enforcement Division of the Department of Manpower and Employment conducted ‘Operasi Usai 239/2026’ at Jalan Pemancha in Bandar Seri Begawan recently to enforce compliance with the Employment Act, Chapter 278, with the investigation revealing a female worker was allegedly not paid during her maternity leave.

The inspection of a communication equipment repair business uncovered five alleged violations of the Employment Act involving a foreign worker.

Some of the alleged offences included violations of Section 63, for failing to provide a rest day; Section 64, for failing to pay legally required wages for work performed on rest days and public holidays; Section 70, for failing to grant gazetted public holidays; Section 71, for failing to provide paid annual leave; and Section 91, for failing to provide maternity leave in accordance with the prescribed regulations.

Investigations will be conducted into the alleged violations of the Employment Act, Chapter 278.

If found guilty, the employer may be issued a compound fine of up to BND1,000 for each offence.

The failure to pay the compound fine may result in the employer being brought before the court.
