Company faces investigation over workers’ rights breaches

A company carrying out cleaning and building maintenance work in Lumut is being investigated over three alleged breaches of the Employment Order, including unauthorised salary deductions and assigning a foreign worker duties different from his approved position.

The Department of Manpower and Employment (DME), under the Ministry of Home Affairs, said its Law Enforcement Division in Belait conducted Operation Usai 243/2026 in the Liang area on October 28.

An inspection found that the employer was suspected of committing three offences under the Employment Order, Chapter 278.

These included making unauthorised deductions from workers’ salaries under Section 44, failing to provide certified sick leave under Section 72, and breaching the conditions of a foreign worker recruitment licence under Section 112(2).

In the third offence, a worker employed as a labourer was found carrying out duties as a supervisor.

Further investigations are ongoing. If found guilty, the employer may be issued a compound fine of up to BND1,000 for each offence. Failure to pay the compound fine may result in the employer being brought to court.

The department reminded employers to safeguard workers’ welfare and comply with the Employment Order.

Employers are required to provide written employment contracts signed by both parties, pay double wages or provide replacement leave for work on public holidays, grant gazetted public holidays and provide paid annual leave after employees have served for three months with the same company.
